On Spicy IP, I recently posted a note relating to the Competition Commission; in light of the fact that several of the provisions of the Competition Act, 2002 are now in force. Further, in corporate-related issues, two important English decisions are noteworthy. One – in relation to the fiduciary duties of directors and the scope of the ‘corporate opportunity’ doctrine – is discussed here. The other decision, on some aspects of auditor’s liability, is discussed on Corporate Law and Governance.
Meanwhile, with respect to strict scrutiny, another important judgment, Subhash Chandra v. Delhi Subordinate Services Board, is available here, thanks to Law and Other Things. I will comment on this I detail later.
Finally, in terms of the regularity of posts on this blog, I will not be able to maintain consistency. I will keep updating the blog from time to time; and regularity may be a problem.
